If you continue to order products in our online store, it means that you are familiar with and agree to the full terms and conditions of business. Glacier Studio Sergej Glažar s.p. reserves the right to change the terms and conditions. All changes are binding on buyers, so we recommend that you regularly check the terms and conditions.

General Terms and Conditions of Business and Information about the Provider

The general terms and conditions of business are composed in accordance with the regulations in the field of consumer protection, based on the recommendations of the Chamber of Commerce and Industry of Slovenia and international codes for online and electronic business.

The website is intended for the presentation and sale of products and services to the user. It is managed by Glacier Studio Sergej Glažar s.p. (hereinafter referred to as the provider or seller).

The user is a person who uses our website, i.e., a buyer in an online order. The buyer (also referred to as a customer, user, or consumer) is a natural or legal person who orders a delivery service of products through the website.

The buyer is bound by the general terms and conditions that are valid at the time of placing the online order.

The general terms and conditions cover the operation of the website, user rights, and the business relationship between the provider and the buyer.

By placing an online order, the buyer declares that all the data provided is true and complete, that they are legally capable, and that there is no known obstacle preventing them from ordering and purchasing products on the website.

Glacier Studio Sergej Glažar s.p., in accordance with the privacy and security statement, collects only the basic data necessary to fulfill obligations.

To place a valid order or purchase a product, the person who placed the order must be 18 years of age or older.

Ordering and Inquiry Process

Ordering: Ordering takes place via the internet 24 hours a day, every day of the year. The consumer selects and orders products available on the website, categorized accordingly. Products are ordered by filling out electronic forms.

Technical Steps Leading to the Conclusion of the Purchase Contract on the Website:

  • Searching for individual products in the product offer on the online store.
  • Selecting the product for purchase.
  • Adding the selected product to the shopping cart.
  • Determining the quantity of the product in the shopping cart.
  • Reviewing the price of the selected product in the chosen quantity, including the calculated tax if applicable.
  • Selecting the delivery method for the product.
  • Selecting the payment method.
  • Reviewing the order with the chosen delivery method and calculated delivery costs.
  • Confirming and placing the order, thus completing the purchase.

Technological Means Enabling the Identification and Correction of Errors before Placing the Order: Before placing the order, the user (buyer) is enabled, through the graphical user interface, to easily and without difficulty:

  • See and review which products have been selected and added to the shopping cart.
  • See and review the price of each product and the total price of the entire selected quantity of each product.
  • Change the selected quantity of each product and recalculate the new price of the changed quantity.
  • Remove selected products that they do not wish to purchase from the shopping cart.
  • Calculate the applicable tax based on the tax rate for the selected product and its price.

Before confirming the order, the user (buyer) is enabled, through the graphical user interface, to easily and without difficulty:

  • Change the selected delivery method for the product.
  • Change the selected payment method.
  • Review and confirm individual changes.

Order Received: After placing the order, the user (buyer) receives a notification via email that the order has been received. Within one hour of receiving this notification, the user (buyer) has the option to cancel the order without consequences. Except for the possibility of cancellation, the user (buyer) cannot change the content of the order after it has been placed. The buyer must inform the provider of any changes or cancellations by emailing sergio@theglacierstudio.com.

Order Confirmed: If the user (buyer) does not cancel the order, the order goes into further processing. The seller reviews the order, checks the availability of the ordered products, and confirms the order or rejects it with a reason. The seller may also contact the user (buyer) by phone for verification purposes. At this stage, the purchase contract for the ordered products between the user (buyer) and the seller is irrevocably concluded.

For the delivery of goods that the provider does not have in stock in its own warehouse, the provider is exclusively bound by the delivery from the supplier and the time it takes for the supplier to deliver the goods to the provider. The provider will inform the buyer via email about the current delivery status. If the delivery period is very long and the buyer does not wish to wait, they can inform the provider, who will remove the item from the order and refund any already paid amounts, or, at the buyer’s choice, deliver the remaining items or cancel the entire order. The provider does not assume any responsibility for damage that would result from longer delivery times or the non-delivery of goods that the provider does not have in stock.

Goods Dispatched: The seller prepares and dispatches the ordered products within the agreed period and notifies the user (buyer) by email.

Inquiry: The inquiry form does not apply to the purchase of a product. In the case of an inquiry, the purchase process is subsequently agreed upon with the buyer.

Purchase Contract

The seller issues an invoice in written form with itemized costs to the user who purchases a product from the online store.

The purchase contract (i.e., the first electronic message about the order status) is stored electronically on the company’s server and is always accessible upon the consumer’s request.

The purchase contract is concluded in the Slovene language.

The purchase contract between the seller and the user (buyer) is concluded at the moment the seller confirms the order. From that moment on, all prices and other conditions of purchase are fixed and apply to both the seller and the user (buyer).

Cancellation of the Order

The user can cancel the placed order without additional costs within one hour of receiving the order notification. Except for the possibility of cancellation, the user (buyer) cannot change the content of the order after it has been placed. The order can only be canceled by emailing sergio@theglacierstudio.com. The user must provide the following information in the cancellation:

  • Order number
  • Buyer’s name and surname
  • Buyer’s address

Availability of Information

The provider undertakes to always provide the buyer with the following information:

  • Company identity
  • Contact addresses
  • Essential characteristics of the goods or services
  • Availability of products
  • Conditions of delivery of the product or performance of the service
  • All prices clearly and unambiguously defined
  • Method of payment and delivery
  • Validity period of the offer
  • The period within which it is possible to withdraw from the contract and the conditions for withdrawal, and how much such a return costs the user
  • Explained complaint procedure, including all information about the contact person or customer service

Validity of Promotional Offers

The validity periods of promotions are indicated with the promotional offer, which may differ from each other.

Product Offer, Delivery Period, and Collection

The product offer in the online store is subject to change frequently and quickly due to the nature of online business.

The delivery period for products in stock is 3 working days for delivery addresses in Slovenia unless the GLS delivery service delivers later to a particular delivery address. For products not in stock for delivery addresses in Slovenia, the delivery period will be communicated via email. Each product from the online store is available within a reasonable period.

The user can choose one of the following collection methods when placing an order:

  • In person at the company’s headquarters or by prior arrangement about the place and time of collection, in which case no postal charges apply.
  • By delivery, in which case the buyer pays the shipping costs in EUR.

Prices

The online price applies to all users of the provider’s online store.

All prices in the online store are in euros and include VAT unless explicitly stated otherwise. All prices in the online store are product prices and do not include delivery costs. All prices apply only to electronic orders of products through the online store.

All prices are valid at the time of placing the order and do not have pre-determined validity, so they apply only until each respective change. Despite exceptional efforts to ensure the most up-to-date and accurate information, it may happen that the price information is incorrect. In the event of the previous sentence and if the price of the product changes during the order processing, i.e., from the moment the order is placed until it is confirmed, the provider will:

  • Inform the user (buyer) and notify them of the new prices, in which case the user (buyer) has the option to change their order or cancel it in whole or in part without additional costs or confirm the order at the new prices.
  • Enable the user (buyer) to withdraw from the purchase and offer a solution that will be mutually beneficial and satisfactory.

Discounts are not cumulative.

Glacier Studio Sergej Glažar s.p. reserves the right to demand payment for goods before dispatch for larger order values.

Payment Methods

The provider offers the user the following payment methods for purchasing products from the online store:

  • Cash on Delivery: The buyer pays for the purchase upon receiving the package in cash to the courier.
  • Credit or Debit Cards: The buyer safely pays for the ordered products with a credit or debit card (Maestro, MasterCard, Visa) when placing the online order.
  • PayPal: The buyer safely pays for the ordered products through a PayPal account.
  • Bank Transfer: The buyer pays the order amount in advance to the provider’s bank account. The package is dispatched after receiving the buyer’s payment.

Payment by credit or debit card is only possible if the payer’s details in the user’s profile match the details in the user’s profile for the cardholder.

Customer Responsibilities

The buyer is obliged to check the accuracy of the information on the invoice and inform the seller of any errors within eight days of receipt. Later complaints will not be considered.

Delivery Within Slovenia

If the goods are in stock, they are dispatched no later than two working days from the day of confirmed order.

The usual delivery period for items in stock is 2-3 working days. The usual delivery period for items not in stock is 3-6 working days.

Invoices

An invoice for the purchase is included with the delivery and generated automatically. The invoice is based on the order (i.e., the sales contract concluded remotely).

Consumer’s Right to Withdraw from the Contract

The consumer (this only applies to natural persons who acquire an item for purposes outside their gainful activity) has the right to notify the seller within 14 days of receiving the items that they are withdrawing from the contract without having to state a reason for their decision. The period begins one day after the date of receipt of the items.

Withdrawal from the contract must be notified to the seller by email: sergio@theglacierstudio.com. A withdrawal form is available to the user, sent by email.

In case of withdrawal from the contract, the consumer returns the received item by mail to the company’s warehouse address.

The consumer must return the item to the seller undamaged and in the same quantity, unless the item is destroyed, spoiled, lost, or its quantity has decreased without the consumer’s fault. The consumer may not freely use the items until the withdrawal from the contract. The consumer may inspect and test the items to the extent necessary to establish the actual situation. The consumer is responsible for a decrease in the value of the goods if the decrease results from actions not necessary to establish the nature, characteristics, and functioning of the goods.

The only cost borne by the consumer in connection with the withdrawal from the contract is the cost of returning the items (which, in the case of shipping, is charged according to the price list of the delivery service and depends on whether it is a shipment/package/consignment). The item must be returned to the seller no later than 14 days from the sent notification of withdrawal from the contract.

The consumer has no right to withdraw from the contract for contracts where the subject of the contract is an item manufactured according to the consumer’s precise instructions, tailored to their personal needs, which is not suitable for return, which is perishable, or whose expiration date has already expired. The possibility of withdrawal from the contract does not exist for the purchase of software or audio and video carriers if the consumer has opened the security seal.

The consumer is not entitled to withdraw from the contract for goods:

  • Goods or services whose price depends on fluctuations in the market, over which Glacier Studio Sergej Glažar s.p. has no control and which may occur within the withdrawal period.
  • Goods manufactured according to the consumer’s precise instructions and tailored to their personal needs.
  • Goods which are not suitable for return due to their nature, are perishable, or their expiration date has already expired.
  • Services performed if Glacier Studio Sergej Glažar s.p. has fully fulfilled the contract and the performance of the service began with the consumer’s express prior consent and acknowledgment that they lose the right to withdraw from the contract when the contract is fully fulfilled.
  • Sealed audio or video recordings and computer programs if the consumer has opened the security seal.
  • Sealed goods that are not suitable for return due to health protection or hygiene reasons if the consumer has opened the seal.
  • The purchase of pet food if the packaging is opened or damaged.
  • Goods that are inseparably mixed with other items due to their nature.
  • Digital content not delivered on a tangible medium if the performance of the service began with the consumer’s express prior consent and acknowledgment.

Refunds of payments made, including delivery costs (except for additional costs due to the choice of a type of delivery that is not the most economical standard delivery offered by the company), will be made as soon as possible and no later than 14 days after receiving the notification of withdrawal from the contract. Glacier Studio Sergej Glažar s.p. returns the received payments to the consumer using the same payment method used by the consumer (which is most commonly done by payment to a bank account), except when the consumer has expressly requested the use of a different payment method, and if the consumer does not bear any costs as a result.

In the case of withdrawal from the contract where a bonus code or promotional code was used, these funds are considered a discount and are not refunded to the user. Only the paid amount is refunded to the user. A gift voucher is considered a payment method in the case of withdrawal from the contract and is returned to the user as a gift voucher, and the paid amount is refunded to the user.

In exceptional cases where items are not returned in accordance with the ZVPot, we can offer the consumer the purchase of the item with appropriate compensation, determined by a record upon return. The purchase with a reduced value is taken into account with the consumer’s confirmation by email. The consumer uses the mentioned compensation exclusively for ordering another item of the same or higher value.

When returning a cryptographic wallet that is a security cryptographic device and can provide all the features it offers only if received by the consumer originally packaged, we reserve the right to enforce a reduction in value of up to 80% in the event of the return of this product.

The right to a refund in the case of a warranty claim and material defects are more precisely regulated by the Consumer Protection Act.

Damaged, Destroyed, or Lost Shipment

From the moment the shipment with ordered products is handed over to the post office, the provider is not responsible for cases where physical damage, destruction, or loss of the shipment occurs, nor if there is a shortage of content in the shipment or if the shipment shows signs of opening (the packaging has visible damage). In all these cases, the user must initiate a complaint procedure with the GLS delivery service, bringing the shipment in the same condition as received to the nearest post office without adding or removing anything and filling out a complaint record. The user must also notify the provider at sergio@theglacierstudio.com.

Product Complaints and Warranty

The resolution of complaints and claims under the warranty or material defects are resolved in accordance with the applicable legislation and the Terms and Conditions of Purchase.

Users report product complaints with an existing defect to the provider at sergio@theglacierstudio.com.

Products have a warranty if indicated on the invoice or warranty card. The warranty is valid by following the instructions and conditions on the warranty card and upon presenting the invoice. The warranty period is stated on the warranty card or invoice. Information about the warranty is also provided with the product presentation in the online store. If there is no information about the warranty in the online store, the product does not have a warranty.

The user (buyer) can claim the warranty from the provider or directly from the product manufacturer or its authorized service. The buyer can claim the warranty with the warranty card and invoice.

Material Defect

The consumer can claim their rights under material defects if they notify the seller of the defect within two months from the day the defect was discovered. The consumer must precisely describe the defect in the notification and allow the seller to inspect the item.

The seller is not responsible for material defects on goods that appear two years after the item has been delivered. It is considered that the defect existed at the time of delivery if it appears within six months of delivery.

The consumer who correctly notified the seller of the defect has the right to demand from the seller:

  • To rectify the defect on the item or return part of the paid amount in proportion to the defect.
  • To replace the item with a new, flawless one.
  • To refund the paid amount.

When is a defect material? When:

  • The item does not have the properties necessary for its normal use or trade.
  • The item does not have the properties necessary for a specific use for which the buyer is buying it, which was known to the seller or should have been known.
  • The item does not have properties and qualities that were explicitly or tacitly agreed upon or prescribed.
  • The seller delivered an item that does not match the sample or model, except when the sample or model was shown only for notification purposes.

How to Check the Suitability of the Item?

It is checked with another flawless item of the same type, as well as with the manufacturer’s statements or indications on the item itself.

How to Claim a Material Defect?

The buyer must notify us of any material defect together with a precise description within the legally stipulated period and simultaneously enable the inspection of the item. The form for reporting a material defect is available here.

The right to claim a material defect on the item is more precisely regulated by the Consumer Protection Act.

Privacy Statement – Data Protection and Privacy Policy

Glacier Studio Sergej Glažar s.p., to fulfill or enforce rights under the contractual relationship and direct marketing, establishes, maintains, and manages your personal data only as long as necessary to achieve the purpose for which they were processed. After fulfilling the purpose of processing, we will delete your personal data or disable access to them. Personal data are considered to be all data used to identify the buyer (e.g., name, surname, address, email address, etc.). Glacier Studio Sergej Glažar s.p. ensures the protection of personal data according to the law regulating personal data protection. It also undertakes not to disclose the buyer’s personal data to third parties, except when expressly required by law and when necessary to fulfill obligations. You can request in writing or by phone at any time that we permanently or temporarily stop using your personal data for direct marketing purposes within 15 days of the request.

All data about the buyer is strictly confidential and available only to employees if this data is necessary for work performance. All employees of the company are responsible for operating in accordance with the principles of personal data protection. Glacier Studio Sergej Glažar s.p. undertakes to provide the protection of the buyer’s personal data by collecting only those personal data of the buyer that are necessary to fulfill obligations. Data automatically recorded by visiting the website that is not personal data (e.g., type of browser, number of visits, time of visit, duration of visit, etc.) Glacier Studio Sergej Glažar s.p. has the right to use exclusively for assessing the visitation of the website and for improving content and functionality.

Kobra uses appropriate technological and organizational measures to protect the transfer and storage of personal data and payments.

Credit card authorizations are carried out in real-time with immediate verification of data with banks. Card data is not stored on the provider’s server.

The user is also responsible for their security by ensuring the safety of their username and password and by providing appropriate software and antivirus protection for their computer.

Child Protection

The trader does not accept orders in the online store from anyone known or suspected to be a child without the express permission of their parents or guardians. The trader does not offer free access to products or services that are harmful to children.

The trader will not accept any personal data concerning children without the express permission of their parents or guardians and will not disclose data received from children to third parties except for parents or guardians.

All communication aimed at children will be appropriate to their age and will not exploit the trust of children, lack of experience, or sense of loyalty.

Marketing

Advertising emails must be clearly and unambiguously marked as advertising messages. The sender must be clearly identifiable. The provider will unconditionally respect the user’s wish not to receive advertising messages.

The website is owned by Glacier Studio Sergej Glažar s.p. All rights reserved. The content on the websites may contain material whose copyright may also belong to third parties. Therefore, any dissemination of information from the websites is only allowed with the written approval of the owner.

Limitation of Liability

Glacier Studio Sergej Glažar s.p. strives to ensure the timeliness and accuracy of the data published on its websites. However, the characteristics of the items, delivery period, or price may change so quickly that the seller cannot correct the data on the websites in time. In such cases, the seller will inform the buyer of the changes and allow them to withdraw from the contract or exchange the ordered item.

Kobra may review and reject opinions that contain obvious falsehoods, are inappropriate, misleading, or offensive. The seller is not responsible for the information in opinions and disclaims any liability arising from the provided information in opinions.

Glacier Studio Sergej Glažar s.p. reserves the right to withdraw from the contract if an obvious error is detected. An obvious error is an error in the essential characteristics of the item and all errors considered decisive according to trade customs or the intent of the parties, which Glacier Studio Sergej Glažar s.p. would not have confirmed or concluded the contract if known. This includes obvious errors in the price.

Glacier Studio Sergej Glažar s.p. is not responsible for the user, consequently the recipient if the technical capabilities of the user’s, consequently the recipient’s equipment are insufficient for the proper use of the item. Glacier Studio Sergej Glažar s.p. is also not responsible for the user, consequently the recipient if the user’s, consequently the recipient’s knowledge is insufficient for the use of the item.

Complaints and Disputes

Glacier Studio Sergej Glažar s.p. respects the applicable consumer protection legislation. Glacier Studio Sergej Glažar s.p. makes every effort to fulfill its duty of providing an effective system for handling complaints.

Glacier Studio Sergej Glažar s.p. acknowledges that the essential characteristic of consumer disputes is the disproportion between the economic value of the claim and the time and costs required to resolve the dispute, which is also the main obstacle for the consumer not to initiate a dispute before the court. Therefore, Glacier Studio Sergej Glažar s.p. strives to resolve any disputes amicably.

Out-of-Court Settlement of Consumer Disputes

According to legal norms, Glacier Studio Sergej Glažar s.p. does not recognize any provider of out-of-court settlement of consumer disputes as competent for resolving a consumer dispute that the consumer could initiate in accordance with the Out-of-Court Settlement of Consumer Disputes Act.

SPA & BEAUTY TEA TEJA ŠTRUKELJ BERGINC S.P., as a provider of goods and services, enables online trading within the RS on its website, publishes an electronic link to the online dispute resolution platform (SRPS). The platform is available to consumers here.

The mentioned regulation originates from the Out-of-Court Settlement of Consumer Disputes Act, Regulation (EU) No. 524/2013 of the European Parliament and the Council on online dispute resolution for consumer disputes, and the amendment of Regulation (EC) No. 2006/2004 and Directive 2009/22/EC.

Competitions

The organizer of the competitions is Glacier Studio Sergej Glažar s.p. Participants in the competitions expressly agree to the publication of their name and surname on the websites managed by the executor if they receive a prize. The prize recipient cannot be a legal person. The cash payment of the prize is not possible. None of the employees of the organizer or executor and their relatives can participate in the competitions. The winner receives the prize by mail, and the shipping cost is covered by the organizer. The winner can also collect the prize at the company’s headquarters. Each competition has clearly stated general conditions for participating in the competition.

Promotional Codes and Coupons

A discount code or promotional code provides various benefits when purchasing through the website. The active code is found on the main page of the advertisement message, in the email, or other media. The code offers various benefits, from different gifts to discounts. Each code is always time-limited and must be used within the specified period, otherwise, it is invalid.

Discounts and promotional codes/coupons on individual products do not accumulate.

Promotional codes/coupons can only be redeemed when purchasing online.

Promotional codes/coupons cannot be exchanged for cash.

By subscribing to e-news, you agree to receive messages for the purpose of sending news and are familiar with the privacy policy. Changes to the General Terms and Conditions of Business

The provider may change and/or supplement these General Terms and Conditions of Business in case of changes in regulations governing the operation of online stores, data protection, and other areas related to the operation of the online store, and in case of changes in its own business policy, of which it will inform users in an appropriate manner, particularly through the website. Each change and/or supplement to the General Terms and Conditions of Business will start to apply and be used after the expiration of an eight-day period from the date of publication of the changes and/or supplements. If the change and/or supplement to the General Terms and Conditions of Business is necessary to comply with regulations, these changes and/or supplements may exceptionally come into effect and be used in a shorter time.

A user who does not agree with the changes and/or supplements to these General Terms and Conditions of Business must cancel their registration within eight days of the notification of the change and/or supplement, otherwise, it is considered and cannot be proven otherwise that the user accepts the changes and/or supplements to the General Terms and Conditions of Business. The cancellation of registration is made by the user informing the provider of the cancellation in writing.
